Astonous Cloud Solution Pvt. Ltd. is a Salesforce ISV partner headquartered at B-37, S-2, Bhaskar Enclave II, Patrakar Colony, Mansarovar, Jaipur, Rajasthan - 302020, India. We build Salesforce-native applications distributed on the Salesforce AppExchange, currently Astonous Ship (multi-carrier shipping) and ZapBills (invoicing, payment collection, and accounting sync).
You must be at least 18 years old and have the authority to bind the company or organization on whose behalf you are acting to use the Website or request a trial or subscription. If you access the Website or a trial on behalf of a company, you represent that you are authorized to do so.
You agree to use the Website only for lawful purposes and in accordance with these Terms. You shall not: (i) copy, reproduce, distribute, or create derivative works from the Website's content without our prior written consent; (ii) attempt to gain unauthorized access to the Website, our systems, or any account not belonging to you; (iii) use any automated means (bots, scrapers, or similar) to access the Website except as permitted by robots.txt; (iv) introduce any virus, malware, or other harmful code; or (v) use the Website to compete with Astonous, including for benchmarking or competitive analysis without our prior written consent.
Astonous may offer a free trial of Astonous Ship and/or ZapBills, currently up to thirty (30) days, to help you evaluate the applications before purchase. Trial terms (including duration, available features, and data handling) are as described at the time the trial is offered and are also governed by the applicable Product Agreement. Astonous may modify, limit, or discontinue trial offers at any time. See our Return and Refund Policy for how trials interact with billing.
The Website and its content, including text, graphics, logos, the "Astonous," "Astonous Ship," and "ZapBills" names and marks, and the underlying software, are owned by Astonous or our licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features without our prior written permission. Your rights to use the Astonous Ship and ZapBills applications themselves are governed exclusively by the applicable Product Agreement.
The Website, Astonous Ship, and ZapBills may reference or link to third-party websites, carrier networks, accounting platforms, or payment processors (such as Salesforce, shipping carriers, QuickBooks, Xero, or Stripe) that are not owned or controlled by Astonous. We are not responsible for the content, policies, or practices of any third-party site or service. Your use of those third-party services is governed by their own terms and privacy policies, and, where relevant, by the data-flow terms described in our Astonous Subprocessor & Data Flow Disclosure.
If you choose to submit ideas, suggestions, or feedback about the Website or our products, you grant Astonous a perpetual, irrevocable, royalty-free license to use that feedback for any purpose, without obligation or compensation to you.
THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WARRANTIES SPECIFIC TO THE ASTONOUS SHIP AND ZAPBILLS APPLICATIONS, IF ANY, ARE SET OUT EXCLUSIVELY IN THE APPLICABLE PRODUCT AGREEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASTONOUS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE WEBSITE, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LIABILITY ARISING FROM YOUR USE OF ASTONOUS SHIP OR ZAPBILLS IS GOVERNED EXCLUSIVELY BY THE APPLICABLE PRODUCT AGREEMENT.
You agree to indemnify and hold Astonous harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Website.
We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Material changes will be reflected on this page; your continued use of the Website after changes are posted constitutes acceptance of the updated Terms.
We may suspend or terminate your access to the Website at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, Astonous, or third parties. Termination of Website access does not affect any rights or obligations under a Product Agreement you have separately accepted.
These Terms shall be governed by the laws of India, without regard to conflict of laws principles. The courts at Jaipur, Rajasthan, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the Website.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with the applicable Product Agreement(s) and our Privacy Policy, constitute the entire agreement between you and Astonous regarding the Website. No waiver of any term shall be deemed a further or continuing waiver of that term or any other term.
